Copyright & Takedown Policy

IWEYmusic respects intellectual property rights. This policy describes how to report copyright infringement, how we handle takedown requests, and how creators may file counter-notices. We operate in compliance with the EU Directive on Copyright in the Digital Single Market (2019/790) and applicable Swedish copyright law (Upphovsrättslagen).

1. Our Commitment

IWEYmusic is a platform for original music created and owned by the uploading artist. Uploading music you do not own the rights to is a violation of our Terms & Conditions and Creator Agreement, and may constitute copyright infringement under Swedish and EU law.

We take copyright seriously. We will act promptly on valid takedown notices and will terminate accounts of repeat infringers.

2. What Constitutes Infringement

The following are examples of infringing content on IWEYmusic:

Uploading a track recorded by another artist without a licence or assignment of rights
Uploading a remix, cover, or interpolation without appropriate synchronisation or mechanical licences
Uploading samples from copyrighted recordings without a sample clearance licence
Using copyrighted artwork, album covers, or photographs without permission
Re-uploading content that has previously been removed due to a valid copyright claim

3. How to Submit a Takedown Notice

If you believe your copyrighted work has been uploaded to IWEYmusic without authorisation, you may submit a takedown notice to our designated copyright agent.

Required Information — Copyright Takedown Notice

Your notice must include all of the following. Incomplete notices may be rejected.

Your full legal name and contact details (email address, phone number, and postal address).
Description of the copyrighted work you claim has been infringed (e.g., track title, release date, original URL or catalogue reference).
URL(s) of the infringing content on IWEYmusic.com — the specific page(s) where the infringing material can be found.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.
Your electronic or physical signature.

3.1 Where to Send Your Notice

Warning: Submitting a false takedown notice is a serious legal matter. Under Swedish and EU law, knowingly misrepresenting that content is infringing may expose you to liability for damages, including costs incurred by the creator.

4. Our Takedown Process

Receipt & Acknowledgement
We acknowledge valid notices within 2 business days of receipt.
Review
We review the notice to confirm it meets all requirements. Incomplete notices will be returned for correction.
Notification to Creator
We notify the creator that a copyright claim has been filed against their content, sharing the notice details (excluding your personal contact information where appropriate).
Content Removal
If the notice is valid and no counter-notice is filed within 10 business days, the infringing content will be removed and access disabled.
Record Keeping
We maintain a confidential record of all takedown notices and actions for legal compliance purposes.

5. Counter-Notice Procedure

If you are a creator whose content has been removed and you believe the takedown was filed in error (e.g., you own the rights, have a licence, or the use constitutes fair dealing), you may submit a counter-notice.

Required Information — Counter-Notice

Your full legal name and contact details.
Identification of the removed content and its location before removal.
A statement under penalty of perjury that you have a good faith belief the content was removed as a result of mistake or misidentification.
Your consent to the jurisdiction of Swedish courts for any legal action arising from the counter-notice.
Your electronic or physical signature.

5.1 Counter-Notice Timeline

Upon receiving a valid counter-notice, we will:

Notify the original complainant within 3 business days
If the complainant does not initiate legal proceedings within 14 business days, restore the removed content
If legal proceedings are initiated, the content remains down pending resolution

6. Repeat Infringer Policy

IWEYmusic maintains a strict repeat infringer policy. Creator accounts that receive:

2 valid, uncontested takedown notices within a 12-month period will receive a formal warning and payout hold
3 or more valid, uncontested takedown notices will result in permanent account termination and forfeiture of pending earnings

Accounts terminated for copyright infringement are not eligible for reinstatement.

7. Platform Liability

IWEYmusic acts as a hosting platform under the EU Directive on Copyright in the Digital Single Market (DSM Directive 2019/790) and Directive on Electronic Commerce (2000/31/EC). We are not liable for user-uploaded content where we:

Had no actual knowledge of the infringing activity, and
Act expeditiously to remove or disable access to infringing content upon obtaining knowledge

Creator warranties and indemnification obligations are set out in the Creator Agreement.
